EV RIDE & DRIVE EVENT

ATTENDEE WAIVER AND RELEASE OF LIABILITY

1. Assumption of RIsk 

I understand that participating in a vehicle test drive event involves potential risks, including but not limited to physical injury, property damage, collisions, or accidents resulting from my actions or the actions of others. I voluntarily assume full responsibility for all risks, whether foreseen or unforeseen, known or unknown.

2. Accidents and Liability

I understand and agree that if I am involved in any collision, crash, or accident during the Event — whether as a driver or passenger — I will be solely and fully responsible for any resulting injuries, losses, or damages to persons or property. This includes damage to the vehicle I am operating, damage to other vehicles or property, and any injuries sustained by myself or others. I agree to hold harmless and indemnify the Organizer, Sponsor, and all Released Parties from any claims, demands, liabilities, or expenses, including those arising from third parties or other event participants, whether or not caused in whole or in part by the negligence of any Released Party. I understand that no insurance coverage is being provided to me by the Organizer or Sponsor for this activity and that I am responsible for carrying and using my own insurance coverage.

I understand that if I am driving a privately owned vehicle during the Event, I am fully responsible for the vehicle while operating it, and I agree to be liable for any damage that occurs while I am in control of the vehicle.

3. General Release and Indemnity

In exchange for being allowed to participate in the Event, I hereby release, waive, and agree to hold harmless Organizer, Sponsor, and all of their officers, employees, contractors, volunteers, sponsors, agents, affiliates, and other associated parties (“Released Parties”) from any and all liability, claims, losses, or damages arising from or related to my participation — including those caused by the negligence of the Released Parties, except where prohibited by law. I further agree not to sue or assert any claims against the Released Parties and agree to indemnify and reimburse them for any expenses (including legal fees) arising from such claims.

4. Medical Fitness and Insurance

I certify that I am in good health, legally licensed to drive (if operating a vehicle), and have no medical or physical conditions that would impair my safe participation. I confirm that I carry adequate insurance or accept full responsibility for any costs, injury, or damage that may arise.

5. Photo and Video Release

I grant permission to the Organizer to photograph and record video of me at the Event and to use such media in marketing, promotional, or other lawful materials in print or digital form, without compensation or further approval.

6. Marketing and Data Use Consent

Participant grants organizer and sponsor permission to collect and use their data, feedback, photos, and testimonials from this event for marketing, promotional, and communication purposes, including follow-up emails. Data will not be sold or shared with unaffiliated third parties. Participant releases organizer and sponsor from any claims arising from such use.

7. General Legal Terms

This release applies to all potential claims, including those not currently known or anticipated, and is intended to be as broad and inclusive as permitted by law. If any part of this agreement is found invalid, the remainder shall remain fully enforceable. This agreement shall be governed in all respects by the laws of the State of New Mexico, without regard to conflict-of-laws principles, and any action to enforce it shall be brought exclusively in the state or federal courts located within New Mexico.

8. Waiver Agreement by Participation

By attending or participating in the Event, I acknowledge that I have read and understood this Waiver and Release of Liability. My participation constitutes my voluntary and full acceptance of its terms, and no physical signature is required.
